I priced these out to go on the boat we have on order. But the guy I talked to said they had to remain below the water line???? I don't understand how this could be.... that would mean that they cannot be used when the boat is on step. I need to do some more research about this. let me know if you find out any good info.

I've been running behind a buddy with these at night on a plane (on step?) and it was blinding. His were white and mounted off to the sides which probably didn't help. Centered, angled down or mounted way low is the only way to go.
So when is this "old enough to know better" supposed to kick in?

On step is a term we have always used to mean "on plane". I guess going fast enough so that the the entire hull has"risen" and is riding on and not through the water. Meaning that the transom has no water against it. When a boat is moving at a cruising speed, the waterline is at the base or the bottom of the transom.....there is no waterline on the transom at cruising speed. that was my confusion, if the lights must be below the waterline than how can they be used at cruising speed if there is no waterline at that speed?
