I spent a little time on a texas game warden boat last weekend after the fireworks show. Suspected me of BWI and I had to go on shore to do field sobriety tests. Had one beer during fireworks which I told them, but I guess they just assume anybody who says they had one is lying and actually had more. Needless to say I owned all the tests and they let me go. Sad thing is they broke more laws then me (0) on the way to do the tests, smashed into another game warden boat pretty good and went threw two no wake zones. Come to find out the reason they stopped me was because I stopped in the middle of two bridges to take my american flag off the tower so it didn't hit the lower of the two while I was crossing under. They couldn't see that at night so thought I didn't know where I was going.
Damn Police!! Guess its a good thing you hadn't had too much to drunk brother!

Not sure it's ridiculous or a hassle thou. If they saw him drinking a beer, or like B said he told them he had 1 beer, I would expect a sobriety test be done. Everyone, and I mean nearly everyone, who is arrested for an intox offense always says they "only had 1". Next step for law enforcement is to conduct FST's to determine if that is truthful or not.
It was an inconvenience for B no doubt, but I would much rather have TPW "inconvenience folks" than get smacked by some drunk on a holiday when I have my wife and kids on the water with me. Just my .02 cents

I am not against a sobriety tests but to pull him off his boat and drive him to shore to conduct it is a bit excessive. These guys are supposed to be trained to tell if someone is drunk, and im sure Brandon was not stumbling about after one beer. I just feel like they could have conducted any sobriety tests from the water and avoided pulling him off his boat and away from the people he was wit to conduct said test. Maybe I am wrong and sobriety tests dont work in boats though.
Your right David, what he should have done was give B a HGN test, which is the test on the eyes. The HGN will give you enough to make a determination if the driver is intoxicated or not and from there you move on to the field tests. Field tests can't be done on a boat but the HGN could have been and proceed accordingly from there
